It conducts a fresh review of the decision and has the power to affirm, vary, or set aside the original decision and substitute a new outcome. Strict time limits apply, and applications must be lodged within the specified timeframe after receiving the decision.
  • ✦Judicial Review — Federal Courts Judicial review is available where a decision may involve a jurisdictional error, meaning a legal mistake made by the decision-maker. These matters are heard in the Federal Circuit and Family Court of Australia or the Federal Court of Australia. Judicial review does not reconsider the merits of the visa application. Instead, it examines whether the decision was legally valid and made in accordance with the law.
  • ✦Ministerial Intervention Ministerial Intervention is a highly discretionary process available in limited circumstances after all other visa and review options have been exhausted. The Minister is not required to consider or intervene in any case, and this power is generally exercised only in exceptional circumstances.
  • ✦Sponsorship & Nomination Refusals Sponsorship and nomination decisions in employer-sponsored visa matters may also be subject to review. Whether review rights are available depends on the type of decision and the specific visa pathway involved.
