विदेशमा बसोबास गर्ने नेपाली दम्पतीहरूले आपसी समझदारीमा छोटो समयमै नेपालस्थित जिल्ला अदालतबाट सम्बन्ध विच्छेद गर्न सक्छन्। यसका लागि दुवै पक्षले नेपालमा रहेका आफ्ना एकाघरका आफन्त वा विश्वासिला व्यक्तिलाई अधिकृत वारेस (Power of Attorney) नियुक्त गर्नुपर्छ। अधिकृत वारेसनामाको कागजात नेपालबाट तयार गरी सम्बन्धित देशस्थित नेपाली राजदूतावास (Embassy) वा कन्सुलर कार्यालयबाट प्रमाणीकरण गराएपछि नेपाल पठाई कानुनी प्रक्रिया अघि बढाउन सकिन्छ।

१. अधिकृत वारेसनामा तयार गर्ने

नेपालमा कानुन व्यवसायीको सहयोगमा अधिकृत वारेसनामाको लिखत तयार गर्नुपर्छ। उक्त लिखतमा सम्बन्धित व्यक्ति हाल नेपालमा उपस्थित हुन नसकेको र आफ्नो कानुनी अधिकार नेपालमा रहेका आफन्त वा विश्वासिला व्यक्तिलाई प्रत्यायोजन गरेको उल्लेख गरिन्छ। वारेसनामा दिने र लिने दुवै पक्षको सक्कल नागरिकता आवश्यक पर्छ।

२. साक्षीहरूको व्यवस्था गर्ने

अधिकृत वारेसनामामा कम्तीमा दुई जना साक्षी आवश्यक हुन्छन्। साक्षीहरूले आफ्नो सक्कल नागरिकता सहित उपस्थित भई कानुन व्यवसायीसमक्ष हस्ताक्षर गर्नुपर्छ।

३. वारेसनामाको लिखत पूर्ण गर्ने

अधिकृत वारेस नियुक्त हुने व्यक्तिले आफ्नो फोटो, ल्याप्चेछाप (औंठाछाप) तथा हस्ताक्षर उपलब्ध गराउनुपर्छ। साथै साक्षीहरूको हस्ताक्षर समेत भएपछि अधिकृत वारेसनामाको लिखत पूर्ण रूपमा तयार हुन्छ।

४. विदेशमा प्रमाणीकरण गर्ने

नेपालबाट तयार गरिएको अधिकृत वारेसनामाको सक्कल कागजात सम्बन्धित व्यक्तिलाई विदेश पठाइन्छ। त्यसपछि उक्त व्यक्तिले आफू बसोबास गरिरहेको देशस्थित नेपाली राजदूतावास वा कन्सुलर कार्यालयबाट वारेसनामालाई प्रमाणीकरण गराउनुपर्छ। प्रमाणीकरणपछि उक्त कागजात पुनः नेपाल पठाउनुपर्छ।

५. सम्बन्ध विच्छेदको मुद्दा दर्ता गर्ने

प्रमाणित अधिकृत वारेसनामा प्राप्त भएपछि एक पक्षको अधिकृत वारेसले सम्बन्धित जिल्ला अदालतमा सम्बन्ध विच्छेदको मुद्दा दर्ता गर्न सक्छ।

६. आपसी सहमतिमा प्रक्रिया टुंग्याउने

अर्को पक्षको अधिकृत वारेसले अदालतमा उपस्थित भई मुद्दा सकार गर्ने, प्रतिउत्तर पेश गर्ने तथा दुवै पक्षको सहमतिअनुसार सम्बन्ध विच्छेदको प्रक्रिया पूरा गर्ने कार्य गर्दछ। सबै प्रक्रिया सहमतिमै सम्पन्न भएमा अदालतबाट सम्बन्ध विच्छेदको निर्णय प्राप्त गर्न सकिन्छ।
