Visa Cancellations

Overview

Visa cancellation is one of the most serious actions available under the Migration Act 1958 (Cth).

Unlike a refusal, cancellation removes a visa that has already been granted. Once it takes effect, the person may become an unlawful non-citizen, which can expose them to detention, removal from Australia, and potential re-entry bans depending on the circumstances.

The Main Cancellation Powers

General grounds — sections 116 and 109

Section 116: non-compliance with visa conditions (for example breaching work limitations) or changed circumstances (for example a relationship ending during a partner visa process). Section 109: incorrect information or bogus documents in an application — which can ground cancellation even years after grant.

Mandatory character cancellation — s501(3A)

Cancellation is mandatory where a visa holder is serving a full-time custodial sentence and has a substantial criminal record (a sentence, or cumulative sentences, of 12 months or more) or has been convicted of a sexually based offence involving a child. The person is notified after cancellation and has a strict 28-day window to request revocation.

Hate and extremism grounds

The Combatting Antisemitism, Hate and Extremism (Criminal and Migration Laws) Act 2026 added specific grounds on which the Minister or a delegate may refuse or cancel a visa — covering hate-motivated conduct, offences relating to the spread of hatred or extremism, and association with prohibited hate groups.

The Show-Cause Process

Step 1 — The Notice (NOICC)

Other than in mandatory or certain border cases, procedural fairness requires the Department to first issue a Notice of Intention to Consider Cancellation, setting out the information and legal grounds it is relying on.

Step 2 — A Short Response Window

Response periods are often very short — sometimes as little as five working days, depending on the ground. This response is your principal opportunity to stop the cancellation, and it should be treated with the same care as a court submission. Anything you say can be relied on in later proceedings.

Step 3 — The Weighing Exercise

In discretionary character matters, decision-makers apply Ministerial Direction No. 110, which treats the protection of the Australian community as the primary consideration, weighed against matters including the best interests of affected children and the strength of your ties to Australia. Where a delegate cancels a visa onshore, there is generally a right of merits review at the Administrative Review Tribunal (ART), within strict deadlines. However, a win at the Tribunal is not always the end of the matter: the Minister holds a personal power under section 501BA(2) to set aside an ART revocation decision and cancel the visa again where satisfied it is in the national interest, and the courts have held this power is not subject to a fixed time limit. Anyone in this position should obtain advice about managing that ongoing risk.
