  • ✦Judicial Review of Migration Decisions

Judicial review involves applying to a federal court to determine whether a migration decision β€” made by the Department or the Administrative Review Tribunal β€” was legally valid.

The Court does not reconsider the facts, re-evaluate evidence, or decide whether a visa should be granted.

Instead, it considers whether the decision involved a jurisdictional error, meaning a legal error significant enough to make the decision invalid under law.

Common Grounds of Jurisdictional Error

A court can set aside a decision on grounds of jurisdictional error, including:

1. Denial of procedural fairness

You were not given a genuine opportunity to respond to adverse information that mattered to the outcome.

2. Misapplication of the law

The decision-maker misunderstood the statute, applied the wrong legal test, or asked the wrong question.

3. Relevant and irrelevant considerations

The decision took into account matters it was not permitted to, or ignored matters it was legally required to consider.

4. Legal unreasonableness and no evidence

A critical finding had no evidentiary basis, or the decision was so unreasonable or illogical that no reasonable decision-maker could have reached it.

Where Judicial Review Happens

Federal Circuit and Family Court of Australia (FCFCOA)

Most migration judicial review applications are heard in Division 2 of the FCFCOA.

Federal Court of Australia

Hears appeals from the FCFCOA, and certain matters at first instance β€” including some challenges to personal decisions of the Minister.

High Court of Australia

Holds original constitutional jurisdiction. Proceedings here are exceptional and typically involve significant questions of principle.

The Practical Realities

The 35-day window

An application for judicial review of a migration decision must generally be filed within 35 days of the date of the decision as notified to you. The court has a limited discretion to extend time where it is necessary in the interests of the administration of justice β€” but extensions are never assumed, and delay can permanently extinguish your ability to challenge an invalid decision.

An honest assessment first

Not every unfavourable decision contains a jurisdictional error. Court proceedings involve real costs β€” including the risk of a costs order if you lose β€” and significant time. Before anything is filed, we review the Tribunal’s decision and the record carefully and give you a frank assessment of your prospects, so the decision to litigate is an informed one.

Test the Legality of the Decision β€” Properly

A generic application that does not identify a precise error of law will be dismissed quickly, with costs. We examine the Tribunal record forensically, identify genuine jurisdictional errors where they exist, and brief specialist counsel where the matter warrants it.
