  • ✦Administrative Review Tribunal (ART) Appeals

The Administrative Review Tribunal (ART) is the independent body responsible for conducting merits review of migration and protection decisions.

It replaced the Administrative Appeals Tribunal (AAT) on 14 October 2024.

The ART can review decisions made by delegates of the Minister, including visa refusals, visa cancellations, and sponsorship and nomination decisions. It conducts a fresh review of the case and may affirm, vary, or set aside the original decision.

What merits review means

Unlike a court, which only checks whether the law was applied correctly, the ART considers your case afresh. It stands in the shoes of the original decision-maker, re-examines the facts against the law, and decides what the correct or preferable decision is. It can affirm, vary or set aside the decision, or send the matter back to the Department with directions.

Limits on new evidence

Although merits review is generally a fresh look, the Migration Act restricts the new information the Tribunal can consider for some kinds of decisions β€” particularly certain employer-sponsored matters. Where these limits apply, your case may largely stand or fall on the material that was before the Department, which makes the quality of the original application and any review submissions critical.

The ART Process

Step 1 β€” Lodge Within the Deadline

Review must be lodged within strict, non-extendable statutory deadlines. The period depends on the decision type and your circumstances β€” it can be as short as 21 days β€” and the date in your notification letter governs. Lodging on time also generally preserves your bridging status while the review runs.

Step 2 β€” Paper-Based or Oral Review

Since May 2026, the ART must decide certain temporary visa refusal reviews on the papers, without an oral hearing β€” applying first to student visa refusals. For matters in this track, your written submissions and evidence are your only opportunity to be heard, and must be complete at lodgement. Other matters proceed to a hearing before a Tribunal member, where you can give evidence and be represented.

Step 3 β€” The Decision

The Tribunal will affirm the decision, vary it, set it aside and substitute a new decision, or remit the matter to the Department with directions β€” for example, a direction that you meet particular criteria.

If the ART Affirms the Refusal

If the ART affirms the refusal, several paths may still be available:

1. Judicial review

An application to the Federal Circuit and Family Court of Australia, limited to whether the Tribunal made a jurisdictional error of law.

2. Ministerial intervention

With a finalised ART decision, you may request the Minister’s personal intervention on public interest grounds.

3. A further application

Depending on the visa and the basis of refusal, a fresh application with new circumstances or stronger evidence may be open β€” onshore bars need to be checked first.

4. Departing and reapplying

Where onshore options are closed, departing Australia lawfully and lodging a well-prepared application from offshore is sometimes the most realistic path. We help structure this so your immigration history is protected.
